The Education (School Inspection) (England) (Amendment) Regulations 2009

In exercise of the powers conferred by sections 5 and 48(3) of the Education Act 2005( 1 ), the Secretary of State for Children, Schools and Families makes the following Regulations:

Citation, commencement and application

1. —(1) These Regulations may be cited as the Education (School Inspection) (England) (Amendment) Regulations 2009 and come into force on 1st September 2009.

(2) These Regulations apply to schools in England only.

Amendment of Regulations

2.The Education (School Inspection) (England) Regulations 2005( 2 ) are amended as follows.

3. For regulation 3, substitute—

3. For the purposes of subsection (1)(a) of section 5 of the 2005 Act, the Chief Inspector shall inspect each school to which that section applies within 5 school years from the end of the school year in which the last inspection of the school took place. .

4. For regulation 10, substitute—

10. For the purposes of subsection (3) of section 48 of the 2005 Act, the governing body shall secure that any inspection takes place within 5 school years from the end of the school year in which the last inspection took place. .
