The Queen’s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by sections 5 and 7 of the West Indies Act 1962( 1 ) and of all other powers enabling Her to do so, is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows—

Citation, construction and commencement

1. —(1) This Order may be cited as the Turks and Caicos Islands Constitution (Interim Amendment) (Amendment) Order 2009 and shall be construed as one with the Turks and Caicos Islands Constitution Order 2006 ( 2 ) and the Turks and Caicos Islands Constitution (Interim Amendment) Order 2009 ( 3 ) (in this Order referred to as “the 2009 Order”).

(2) This Order shall come into force on such day as the Governor, acting in his or her discretion, may appoint by proclamation published in the Gazette.

Amendment of section 1 of 2009 Order

2. Section 1 of the 2009 Order is amended by substituting for subsection (3) the following—

(3) This Order shall come into force on such day as the Governor, acting in his or her discretion, may appoint by proclamation published in the Gazette, and different days may be appointed for the coming into force of different provisions.

(4) When appointing a day for the coming into force of sections 7 and 8, the Governor shall specify which provisions of Schedules 1 and 2 shall come into force on that day, and if any of the provisions of those Schedules do not come into force on that day, the Governor may appoint a different day or days for the coming into force of those provisions.

(5) In subsections (3) and (4), the term “provisions” includes any part of any provision.

Amendment of sections 4, 5 and 6 of 2009 Order

3. Sections 4, 5 and 6 of the 2009 Order are amended by substituting for the words “this Order” the words “this section”.

Amendment of sections 7 and 8 of 2009 Order

4. Sections 7 and 8 of the 2009 Order are amended by substituting for the words “While this Order is in force” the words “Subject to subsections (3), (4) and (5) of section 1, while this section is in force”.

Amendment of section 9 of 2009 Order

5. Section 9 of the 2009 Order is amended by substituting for the words “While this Order is in force” the words “Subject to subsection (3) and (5) of section 1, while this section is in force”.
