This Order is made in exercise of the powers conferred by paragraphs 8(1) of Schedule 8 and 3(1) of Schedule 10 to the Traffic Management Act 2004( 1 ).
Derbyshire County Council has applied to the Secretary of State for an order to be made under these powers in respect of part of its area.
The Secretary of State has consulted the Chief Constable of the Derbyshire Constabulary in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.
Accordingly, the Secretary of State for Transport( 2 ) makes this Order.
Citation and commencement
1. This Order may be cited as the Civil Enforcement of Parking Contraventions (County of Derbyshire) Designation Order 2009 and shall come into force on 19th February 2009.
Designation of civil enforcement area and special enforcement area
2. The Secretary of State designates the area described in the Schedule as—
(a) a civil enforcement area for parking contraventions; and
(b) a special enforcement area.

Article 2
SCHEDULE Area designated as a civil enforcement area for parking contraventions and a special enforcement area
This Order applies to the area of the County of Derbyshire with the exception of—
(a) the M1 (including the slip roads);
(b) the A52 (including the slip roads) from the boundary with the County of Nottinghamshire (at Ordnance Survey National Grid reference point SK483360) to the boundary with the City of Derby (at Ordnance Survey National Grid reference point SK412354);
(c) the A50 (including the slip roads);
(d) the A628 from the boundary with the Metropolitan County of South Yorkshire (at Ordnance Survey National Grid reference point SE136002) to a point on Woodhead Road at Tintwistle, west of its junction with Chapel Brow (at Ordnance Survey National Grid reference point SK025973);
(e) the A38 from the boundary with the County of Nottinghamshire (at Ordnance Survey National Grid reference point SK462572) to the boundary with the City of Derby (at Ordnance Survey National Grid reference point SK358399);
(f) the A38 from the boundary with the City of Derby (at Ordnance Survey National Grid reference point SK309330) to the boundary with the County of Staffordshire (at Ordnance Survey National Grid reference point SK268271);
(g) the A6 (including the slip roads) from its junction with the A50 (at Ordnance Survey National Grid reference point SK405305) to the boundary with the City of Derby (at Ordnance Survey National Grid reference point SK399327) including the roundabout at its junction with London Road;
(h) the length of London Road, Thulston, between the A6 and the re-aligned Snelsmoor Lane (at Ordnance Survey National Grid reference point SK399321);
(i) the A6 Chapel-en-le-Frith By-Pass (including the slip roads) between its junctions with the A623 and the A5004;
(j) the A6 Taddington By-Pass between points to the east of its junction with Main Road (at Ordnance Survey National Grid reference point SK153713), and to the west of its junction with School Lane (at Ordnance Survey National Grid reference point SK137713);
(k) the A617 (including the slip roads) from the westerly junction of Bramley Road at Doe Lea (at Ordnance Survey National Grid reference point SK463663) to the roundabout junction with the A61 Derby Road at Chesterfield (at Ordnance Survey National Grid reference point SK387706);
(l) the A61 at Chesterfield (including the slip roads and roundabouts) from its junction with the A617 to the boundary with the City of Sheffield (at Ordnance Survey National Grid reference point SK351802);
(m) the A619 (Rother Way) at Chesterfield between the A61 roundabout and the roundabout at the junction of Rother Way and Tapton By-pass East; and
(n) the A61 at Breadsall from its junction with the A38 to the boundary with the City of Derby (at Ordnance Survey National Grid reference point SK364392).
The Secretary of State is the “appropriate national authority” as regards England for the purposes of Part 6 of the Traffic Management Act 2004 under section 92 of that Act.
