Citation, commencement and application

1. —(1) These Regulations may be cited as the Education (Supply of Information about the School Workforce) (No. 2) (England) (Amendment) Regulations 2009 and come into force on 1st January 2010.

(2) These Regulations apply in relation to England.

Amendments to the Education (Supply of Information about the School Workforce) (No. 2) (England) Regulations 2007

2. The Education (Supply of Information about the School Workforce) (No. 2) (England) Regulations 2007( 2 ) are amended as follows.

3. In regulation 3 (interpretation), after the definition of “A Level” insert—

“ “the administrator of the Teachers’ Pension Scheme” means the person exercising, in pursuance of article 3 of the Contracting Out (Administration of the Teachers’ Pensions Scheme) Order 2003 ( 3 ) , the functions specified in article 2 of that Order; ” .

4. In regulation 8(2) (persons to whom the Secretary of State may supply information for qualifying purposes)—

(a) at the end of sub-paragraph (l) omit “and”; and

(b) at the end of sub-paragraph (m) insert—

“ ; and

(n) the administrator of the Teachers’ Pension Scheme. ” .

5. In Schedule 1 (provision of information by schools and authorities) —

(a) omit the headings “Part 1” and “All Qualifying Workers and Qualifying Trainees”;

(b) for paragraph 1 substitute—

“ 1. In respect of each qualifying worker and qualifying trainee who, during all or part of the census period or on the census date, is or has been employed or otherwise engaged to work at the school or for the authority for a period of at least 28 days or will have completed such a period by the end of his contract, the following information. ” ;

(c) omit the headings “Part 2” and “All School Teachers and Teaching Assistants”; and

(d) omit paragraph 8.
