The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 8 and 181 of the Education and Inspections Act 2006( 1 ).
Citation and commencement
1. These Regulations may be cited as the School Organisation (Establishment and Discontinuance of Schools)(England)(Amendment) Regulations 2009 and come into force on 16th December 2009.
Amendment of the School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007
2. The School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007( 2 ) are amended as follows.
3. In regulation 2 omit the definition of “APA rating”.
4. In regulation 9—
(a) in each of paragraphs (1), (2)(a) and (b) and (5) for “APA” substitute “performance”;
(b) after paragraph (6) insert—
“ (7) In this regulation “current performance rating” means the most recent rating awarded to the authority under section 138(3) of the Act. ” .

S.I. 2007/1288 ; a relevant amending instrument is S.I. 2007/3464 . There are other amending instruments but none is relevant.
