The Legal Services Act 2007 (Maximum Penalty for Approved Regulators) Rules 2009

The Legal Services Board with the consent of the Lord Chancellor makes the following Rules in exercise of the powers conferred by sections 37(4) and 204(2), (3) and (4)(b) of the Legal Services Act 2007( 1 ).

The Legal Services Board has complied with the consultation requirements in section 205 of that Act.

Citation and commencement

(2) These Rules come into force on 1st January 2010.

Maximum penalty

(2) The reference to the approved regulator’s most recent accounting period is to the most recent accounting periodβ€”

(a) which ended before the imposition of the financial penalty; and

(b) for which the regulator has audited accounts which have been drawn up in accordance with generally accepted accounting practice.

(3) The amount of the income referred to in paragraph (1) is to be determined by reference to the audited accounts referred to in paragraph (2)(b).
