The Education (Budget Statements) (England) (Amendment) Regulations 2009

The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 52 and 138(7) of the School Standards and Framework Act 1998( 1 ):

Citation, commencement, application and interpretation

1. —(1) These Regulations may be cited as the Education (Budget Statements) (England) (Amendment) Regulations 2009 and come into force on 31st March 2009.

(2) These Regulations apply only in relation to England and only in relation to the preparation of the second budget statement under regulation 4(3) and (4) of the principal regulations and the third budget statement under regulation 4(5) and (6) of the principal regulations.

(3) In these Regulationsthe principal regulations” means the Education (Budget Statements) (England) Regulations 2008( 2 ).

Amendments

2. —(1) The principal regulations are amended as follows.

(2) In regulation 2(1)—

(a) after the definition of “place-led funding”, insert—

“positive activities”, in relation to young people, means educational leisure-time activities and recreational leisure-time activities provided for the improvement of the well-being of persons aged 13 to 19 and certain persons aged 20 to 24 by or with the assistance of a local education authority under section 507B of the Education Act 1996 ( 3 ) ; ; and

(b) for the definition of “youth service” substitute—

“youth work” means a service provided by or with the assistance of a local education authority under sections 15B ( 4 ) and 507A ( 5 ) and 507B of the 1996 Act ( 6 ) and section 114 of the 2000 Act ( 7 ) ; .

(3) In regulation 4—

(a) in paragraph (3)(b), omit the word “and” at the end of (iv) and omit (v);

(b) in paragraph (5)(b), omit the word “and” at the end of (iii) and omit (iv).

(4) In Schedule 2 (form of the second budget statement) and in Schedule 3 (form of the third budget statement)

(a) in Part 2, in Table 1 – Local Authority Information—

(i) insert the sub-heading “Services to young people” immediately below the heading in section 3, “ YOUTH AND COMMUNITY ”; and

(ii) for the entries in that section substitute the following entries—

(b) in the Annex to Table 1: Early Years Expenditure—

(i) in the heading “Method of counting children for funding the free entitlement”, for the word “for” substitute “and”; and

(ii) for the single column of 3 rows adjacent to the entries under that heading, substitute two columns of 3 rows headed respectively “(a) Counting” and “(b) Funding” adjacent to each other;

(c) omit the Annex to Table 1:Youth Service;

(d) in Part 3, in Table 3a - School level information, below the heading “Additional Pupil Led Funding” omit the column headed “Pre-School Pupil-Led Funding (Nursery classes 3 & 4 years olds)”; and

(e) in Part 4, in Table 4: Funding Factors, omit the section headed “Pre-School Pupil-Led Funding (Nursery Classes) (10)”.
