The Defence Council, in exercise of the powers conferred by section 340 of the Armed Forces Act 2006( 1 ), make the following Regulations:

1. These Regulations may be cited as the Armed Forces (Aliens) Regulations 2009 and come into force on 31st October 2009.

2. Section 340(1) of the Armed Forces Act 2006 shall not apply to a citizen or national of Nepal who serves, or has for not less than five years served, in the Brigade of Gurkhas.
