The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 10(1), 52(1) and 60 of the Public Passenger Vehicles Act 1981( 1 ) and by virtue of the Department for Transport (Fees) Order 2009( 2 ).
In accordance with section 61(2) of that Act he has consulted with such representative organisations as he thinks fit.
Citation and commencement
1. These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) (No. 2) Regulations 2009 and come into force on 3rd May 2009.
Preliminary
2.The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981( 3 ) are amended as follows.
Increases in fees
3. In the regulations specified in column (1) of the Table, for each amount specified in column (2) substitute the amount specified in column (3).

1981 c.14 ; section 10(1) was amended by the Road Traffic Act 1991 (c. 40) , Schedule 4, paragraph 15. Section 52(1) was amended by the Transport Act 1985 (c. 67) (“the 1985 Act”), Schedule 1, paragraph 7, Schedule 2, Part II, paragraph 4(14) and Schedule 8, and by the Deregulation and Contracting Out Act 1994 (c. 40) , section 66(2). Section 60(1) was amended by the 1985 Act, section 134(2), Schedule 2, Part II, paragraph 4(18) and Schedule 8. Section 60(1A) was inserted by the 1985 Act, section 134(2). Section 61(2) was amended by the 1985 Act, section 135(1) and Schedule 8.
S.I. 2009/711 . The relevant provisions in S.I. 2009/711 are article 4 and paragraphs 4 to 6 of Schedule 1, together with article 9 and Schedule 2.
