The Lord Chancellor, in exercise of the powers conferred by sections 58(3)(b) and (4) and 65(1)(b) of the Mental Capacity Act 2005(1), makes the following Regulations:

Citation and commencementI1

1. These Regulations may be cited as the Public Guardian (Fees, etc.) (Amendment) Regulations 2010 and shall come into force on 1st May 2010.

2. The Public Guardian (Fees, etc.) Regulations 2007(2) are amended in accordance with regulation 3.

3. In regulation 10 (reductions and remissions in exceptional circumstances)

(a)before “Where it appears” insert “(1)”; and

(b)at the end, insert—

(2) An application for the reduction or remission of any fee paid under regulation 8 (appointment of deputy: supervision fees) must be made to the Public Guardian within 6 months after the date of the invoice in respect of that fee.

Transitional provisionI4

4. These Regulations apply to applications for the reduction or remission of a fee, the invoice for which is dated 1st May 2010 or later.
