The Secretary of State for Children, Schools and Families makes the following Order in exercise of the powers conferred by section 108(10) of the Children Act 1989( 1 ):

Citation and commencement

1. This Order may be cited as the Isles of Scilly (Children Act 1989) Order 2010 and comes into force on 26th April 2010.

Application of the Children Act 1989 with modification

2. —(1)The Children Act 1989 shall in its application to the Isles of Scilly have effect with the modification in paragraph (2).

(2) In relation to the Isles of Scilly, any reference to a “local authority”( 2 ) is to be construed as a reference to the Council of the Isles of Scilly.

The expression “local authority” is defined in section 105(1) of the Children Act 1989 as meaning, in relation to England “the council of a county, a metropolitan district, a London Borough or the Common Council of the City of London”.
