The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 40(1) and (2)(e), 124(1) and 174(2) and (3) of the Pensions Act 1995( 1 ).

In accordance with section 120(1) of the Pensions Act 1995 the Secretary of State has consulted such persons as the Secretary of State considers appropriate.

Citation and commencement

1. These Regulations may be cited as the Occupational Pension Schemes (Investment) (Amendment) Regulations 2010 and shall come into force on 23rd September 2010.

Amendment of the Occupational Pension Schemes (Investment) Regulations 2005

2. —(1)The Occupational Pension Schemes (Investment) Regulations 2005( 2 ) are amended in accordance with this regulation.

(2) In regulation 13 (investments to which restrictions do not apply), omit paragraph (7).

(3) In regulation 14 (transitional provisions)

(a) omit sub-paragraph (b) of paragraph (1) and the word “or” immediately preceding it; and

(b) omit sub-paragraph (e) of paragraph (2).
