The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 3(2)(b) and (3)(b) of the Safeguarding Vulnerable Groups Act 2006( 1 ):
Citation and commencement
1. This Order may be cited as the Safeguarding Vulnerable Groups Act 2006 (Specified Lists: Scotland) Order 2010 and comes into force on 30th November 2010.
Barred lists
2. For the purposes ofβ
(a) section 3(2)(b) of the Safeguarding Vulnerable Groups Act 2006, the list maintained under section 1(1)(a) of the Protection of Vulnerable Groups (Scotland) Act 2007( 2 ) is specified as a list corresponding to the childrenβs barred list;
(b) section 3(3)(b) of the Safeguarding Vulnerable Groups Act 2006, the list maintained under section 1(1)(b) of the Protection of Vulnerable Groups (Scotland) Act 2007 is specified as a list corresponding to the adultsβ barred list.

2006 c. 47 (βthe Actβ). Section 3 of the Act provides that a person is barred from regulated activity if the person is included in a list maintained under the law of Scotland or Northern Ireland which the Secretary of State specifies by order as corresponding to the relevant barred list maintained under section 2 of the Act. Section 61(1) of the Act provides that a power under the Act to make orders is exercisable by statutory instrument.
