This Order is made by Her Majesty in Council in exercise of the powers conferred upon Her by section 15 of the Scotland Act 1998( 1 ).

In accordance with section 115(1) of, and paragraphs 1 and 2 of Schedule 7 to, that Act a draft of this Order was laid before and approved by a resolution of the Scottish Parliament.

Accordingly, Her Majesty, by and with the advice of Her Privy Council, makes the following Order.

Citation and commencement

1. This Order may be cited as the Scottish Parliament (Disqualification) Order 2010 and comes into force on the day after the day on which it is made.

Specified office-holders

2. An office-holder of a description specified in Part I of the Schedule to this Order is disqualified from being a member of the Scottish Parliament.

3. An office-holder of a description specified in column 1 of Part II of the Schedule to this Order is disqualified from being a member of the Scottish Parliament for any constituency specified in relation to that office-holder in column 2 of that Part of the Schedule and for any region specified in relation to that office-holder in column 3 of that Part of the Schedule.

4.The Scottish Parliament (Disqualification) Order 2007( 2 ) is revoked.

Her Majesty’s Lord-Lieutenant and any Lieutenant for an area in Scotland. Any constituency comprising the whole or part of the area in which the Lord-Lieutenant holds office or for which either the Lord-Lieutenant discharges the Lord-Lieutenant’s functions or the Lieutenant discharges the Lieutenant’s functions. Any region comprising the whole or part of the area in which the Lord-Lieutenant holds office or for which either the Lord-Lieutenant discharges the Lord-Lieutenant’s functions or the Lieutenant discharges the Lieutenant’s functions.
