The Equality Act 2010 (Amendment) Order 2010

The Secretary of State, being a Minister designated( 1 ) for the purposes of section 2(2) of the European Communities Act 1972( 2 ) in relation to discrimination, makes the following Order in exercise of the powers conferred by that section:

Citation, commencement and extent

1. —(1) This Order may be cited as the Equality Act 2010 (Amendment) Order 2010.

(2) This Order comes into force on 30th October 2010.

(3) This Order extends to England and Wales and Scotland.

Amendment of section 76 of the Equality Act 2010

2. In section 76 of the Equality Act 2010( 3 ) (exclusion of pregnancy and maternity discrimination provisions), after subsection (1), insert the following—

(1A) The relevant pregnancy and maternity discrimination provision has no effect in relation to a term of the woman’s work—

(a) that relates to pay, but

(b) in relation to which a maternity equality clause or rule has no effect.
