The Reserve Forces Act 1996 (Isle of Man) Regulations 2010

The Secretary of State makes these Regulations in exercise of the powers conferred by sections 75, 78, 79, 83, 84, 85 and 130 of the Reserve Forces Act 1996( 1 ), as it has effect in the Isle of Man( 2 ), and after consultation in accordance with sections 81(5) and 85(3) of that Act—

Citation and commencement

1. These Regulations may be cited as the Reserve Forces Act 1996 (Isle of Man) Regulations 2010 and shall come into force on 2nd November 2010.

Application of UK Regulations to the Isle of Man

2. The following regulations, namely––

shall apply to the Isle of Man subject to the modifications specified in the Schedule.

Regulation 2

SCHEDULE MODIFICATIONS OF THE REGULATIONS IN THEIR APPLICATION TO THE ISLE OF MAN

PART 1 GENERAL MODIFICATIONS

1. References to any Act of Parliament or statutory instrument extending to the Isle of Man, or to any provision of any such Act or instrument, shall be construed as references to the Act, instrument or provision as it has effect in the Isle of Man.

PART 2 MODIFICATIONS OF SI 1997/307

2. In regulation 2(1), in the definition of “employer”, in paragraph (b), for “1890” substitute “1909 (an Act of Tynwald: Vol. VIII p. 327)”, and in paragraph (d), after “government department” insert “of the United Kingdom or the Isle of Man, including any Department or Statutory Board within the meaning of the Interpretation Act 1976 (an Act of Tynwald: c. 20),”.

3. In Schedule 1, in paragraph 1(a)(ii), for the words from “(“within” to “1995)” substitute “(within the meaning of the Children and Young Persons Act 2001 (an Act of Tynwald: c. 20)”.

PART 3 MODIFICATIONS OF SI 1998/3086

4. Omit regulation 6.

5. Omit regulation 10(1), (2) and (5).

6. In regulation 10(3) for “In section 1(1) of the Customs and Excise Management Act 1979 ” substitute “In section 184(1) of the Customs and Excise Management Act 1986 (an Act of Tynwald: c. 34)”.

PART 4 MODIFICATIONS OF SI 2005/859

7. In regulation 2(1)––

(a) omit the definition of “the 1997 Regulations”;

(b) in the definition of “relevant service” omit “on or after the 14th April 2005”.

8. Omit regulation 5(5).

9. Omit regulation 16.
