Her Majesty, in exercise of the powers conferred upon Her by section 79(3) of the International Criminal Court Act 2001( 1 ), is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows—

Citation and commencement

1. This Order may be cited as the International Criminal Court Act 2001 (Overseas Territories) (Amendment) Order 2010 and shall come into force on 15th April 2010.

2. The International Criminal Court Act 2001 (Overseas Territories) Order 2009( 2 ) is amended as provided in the Schedule.

Article 2

SCHEDULE AMENDMENTS TO INTERNATIONAL CRIMINAL COURT ACT 2001 (OVERSEAS TERRITORIES) ORDER 2009

1. In the heading to article 2, substitute “application” for “interpretation”.

2. In Annex 1, renumber all the sections as 1 to 84 in place of 5 to 88; and all references in the following paragraphs of this Schedule to sections of Annex 1 are references to those sections as so renumbered.

3. In Annex 1, section 15(2)(b), delete the words “or a ship, aircraft or hovercraft registered in the Territory”.

4. In Annex 1, section 20—

(a) In subsection (1)(a), substitute “appropriate judicial officer” for “appropriate judicial authority”;

(b) In subsection (1)(b), substitute “officer” for “authority”.

5. In Annex 1, section 26, substitute “appropriate judicial officer” for “appropriate judicial authority”.

6. In Annex 1, section 67, in subsection (1), substitute “British overseas territories citizen” for “British Dependent Territories citizen”.

7. In Annex 1, Schedule 1, paragraph 5, substitute “order” for “Order” in the heading and in subparagraph (1).

8. In Annex 1, Schedule 5, paragraph 7—

(a) In the heading and in subparagraph (1), substitute “the government” for “a government department”;

(b) In subparagraph (2)(a) and (b), substitute “government” for “department”;

(c) For subparagraph (3), substitute the following—

(3) In this paragraph “government” means the government of the Territory.

9. In Annex 1, Schedule 5, paragraph 9, amend the heading to read “ Effect of Warrant ”.

10. In Annex 1, Schedule 8, Article 6, reletter the subparagraphs as (a) to (e), in place of (c) to (g).

11. In Annex 1, Schedule 8, Article 8, renumber the paragraph as 2 in place of 4.

12. In Annex 1, Schedule 8, Article 8, paragraph 4(b)(xix), after the word “bullets” substitute “which” for “with”.

13. In Annex 1, Schedule 8, Article 9, renumber the paragraphs as 1, 2 and 3, in place of 5, 6 and 7.

14. In Annex 1, Schedule 9, Article 70, renumber the paragraph as 4 in place of (2).

15. In Annex 2, substitute “St Helena, Ascension and Tristan da Cunha” for “St Helena and its Dependencies”.

16. In Annex 3, in the heading, substitute “ADAPTATIONS” for “ADAPTIONS”.

17. In Annex 3, in paragraph 16 and the heading to that paragraph, substitute “St Helena, Ascension and Tristan da Cunha” for “St Helena and Dependencies”.

18. In Annex 3, for paragraph 17 substitute the following—

17. In the application of section 6(2)(a) in the Sovereign Base Areas of Akrotiri and Dhekelia the reference to “summary” shall be deleted.

19. In Annex 3, for paragraph 19 substitute the following—

19. Section 53(2) shall not apply in relation to the Sovereign Base Areas of Akrotiri and Dhekelia.

20. In Annex 3, paragraph 20, substitute “Areas” for “Ares”.
