The Constitutional Reform and Governance Act 2010 (Commencement No. 6, Specified Day and Transitional Provision) Order 2011

The Leader of the House of Commons( 1 ) makes the following Order in exercise of the powers conferred by section 52(2) and (4) of, and paragraph 44(4) and (8) of Schedule 6 to, the Constitutional Reform and Governance Act 2010( 2 ):

Citation and interpretation

1. β€”(1) This Order may be cited as the Constitutional Reform and Governance Act 2010 (Commencement No.6, Specified Day and Transitional Provision) Order 2011.

(2) In this Order β€œthe 2010 Act” means the Constitutional Reform and Governance Act 2010.

Commencement

2. β€”(1) The provisions of the 2010 Act specified in paragraph (2) come into force on 24th October 2011.

(2) The provisions referred to in paragraph (1) areβ€”

(a) Section 40 (Parliamentary and other pensions) in so far as it relates to the provisions specified in subparagraphs (b) and (c);

(b) in Schedule 6 (Parliamentary and other pensions)β€”

(i) Part 1 (Parliamentary and other pensions); and

(ii) Part 2 (Provision which may be included in schemes);

(c) in Part 3 of Schedule 6 (Amendments, transitional provision etc )β€”

(i) paragraph 35(1) and (2);

(ii) paragraphs 36, 37 and 42 to 46;

(iii) paragraph 47(1);

(iv) paragraph 47(2) except in so far as it inserts the words β€œ,4 and 6” and β€œor 4” in paragraph 18(3)(a) of Schedule 1 to the Parliamentary Standards Act 2009( 3 );

(v) paragraph 47(3); and

(vi) paragraphs 48 to 50.

Specified day

3. The specified day for the purpose of paragraph 44(8) of Schedule 6 to the 2010 Act is 24th October 2011.

Paragraph 12 of Schedule 6 to the 2010 Act: transitional provision

4. Any provision of the existing regulations which could not be contained in a scheme under paragraph 12 of Schedule 6 to the 2010 Act has effect as if contained in a scheme under that paragraph.
