The Secretary of State for Health, makes the following Regulations in exercise of the powers conferred by sections 30(4) and 30(6)(a) of the Mental Capacity Act 2005( 1 ).
Citation, commencement and application
1. —(1) These Regulations may be cited as the Mental Capacity Act 2005 (Appropriate Body) (England) Amendment Regulations 2011 and come into force on 1st December 2011.
(2) These Regulations apply in relation to the carrying out of research in England.
Amendment of the Mental Capacity Act 2005 (Appropriate Body) (England) Regulations 2006
2. —(1)The Mental Capacity Act 2005 (Appropriate Body) (England) Regulations 2006( 2 ) are amended as follows.
(2) In regulation 2 (appropriate bodies), in paragraph (b), after “Secretary of State” insert “in exercise of the powers in section 2 of the National Health Service Act 2006( 3 ).”.
