The A453 Birmingham to Nottingham Trunk Road (M1 Junction 24 to A52 Nottingham Improvement and Slip Roads) Order 2012

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10, 41 and 106 of the Highways Act 1980( 1 ) and now vested in her( 2 ):

1. This Order may be cited as the A453 Birmingham to Nottingham Trunk Road (M1 Junction 24 to A52 Nottingham Improvement and Slip Roads) Order 2012 and shall come into force on 24th May 2012.

2. In this Orderβ€”

(1) all measurements of distance are measured along the route of the relevant highway; and

(2) (a) β€œthe main new road” means the new highway which the Secretary of State proposes to construct along the route described in Schedule 1;

(b) β€œthe new trunk roads” means the main new road and the slip roads;

(c) β€œthe plan” means the plans numbered Site Plan Sheet 1 of 2 and Site Plan Sheet 2 of 2 and marked β€œThe A453 Birmingham to Nottingham Trunk Road (M1 Junction 24 to A52 Nottingham Improvement and Slip Roads) Order 2012 HA 10/MP/100”, signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA; and

(d) β€œthe slip roads” means the new highways which the Secretary of State proposes to construct along the routes described in Schedule 2 and which connect the main new road with other highways or proposed highways at the places stated in that Schedule.

3. The main new road and the slip roads shall become trunk roads from the date when this Order comes into force.

4. The centre line of each of the trunk roads is indicated by a heavy black line on the plan.

5. The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads thatβ€”

(a) where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

(b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for traffic.

6. The Secretary of State is authorised to construct the bridge specified in Schedule 3 as part of the main new road given the reference B on Site Plan Sheet 1 of 2.

Article 2(2)(a)

SCHEDULE 1 ROUTE OF THE MAIN NEW ROAD

The route of the main new road is about:

(i) 82 metres in length from a point on the A453 Trunk Road, about 190m north-east of the Long Lane Overbridge, north-eastwards to a point about 272m north-east of the Long Lane Overbridge at Kegworth in the County of Leicestershire, and marked A on the plan.

(ii) 70 metres in length from a point on the A453 Trunk Road, about 35m south-west of the Canal Bridge, north-eastwards to a point about 35m north-east of the Canal Bridge at Ratcliffe on Soar in the County of Leicestershire, and marked B on the plan.

(iii) 0.111 kilometres in length from a point on the A453 Trunk Road, about 180m north-east of the Canal Bridge, north-eastwards to a point about 255m south-west of the River Soar at Ratcliffe on Soar in the County of Leicestershire, and marked C on the plan.

(iv) 90 metres in length from a point on the A453 Trunk Road, about 55m south-west of the River Soar, north-eastwards to a point about 35m north-east of the River Soar at Ratcliffe on Soar in the County of Nottinghamshire, and marked D on the plan.

(v) 66 metres in length from a point on the A453 Trunk Road, about 35m south-west of the Railway Underbridge, north-eastwards to a point about 40m north-east of the Railway Underbridge at Ratcliffe on Soar in the County of Nottinghamshire, and marked E on the plan.

(vi) 3.049 kilometres in length from a point on the A453 Trunk Road, about 5m south-east of the junction of Barton Lane and the A453 Trunk Road, at Thrumpton in the County of Nottinghamshire, north-eastwards to a point about 270m south-west of the junction of Fox Covert Lane and the A453 Trunk Road at Clifton in the City of Nottingham, and marked F on the plan.

Article 2(2)(d)

SCHEDULE 2 ROUTES OF THE SLIP ROADS

The routes of the slip roads are as follows:

(1) Proposed Junction at Ratcliffe on Soar

(a) A route from the westbound carriageway of the main new road to a new roundabout which the Secretary of State proposes to construct at Ratcliffe on Soar (the slip road along this route being given number 1 on the plan), and

(b) A route from a new roundabout which the Secretary of State proposes to construct at Ratcliffe on Soar to the westbound carriageway of the main new road (the slip road along this route being given number 2 on the plan) and

(c) A route from a new roundabout which the Secretary of State proposes to construct at Ratcliffe on Soar to the eastbound carriageway of the main new road (the slip road along this route being given number 3 on the plan) and

(d) A route from the eastbound carriageway of the main new road to a new roundabout which the Secretary of State proposes to construct at Ratcliffe on Soar (the slip road along this route being given number 4 on the plan).

(2) Proposed Junction at Thrumpton

(a) A route from the eastbound carriageway of the main new road to a new roundabout which the Secretary of State proposes to construct at Thrumpton (the slip road along this route being given number 5 on the plan), and

(b) A route from a new roundabout which the Secretary of State proposes to construct at Thrumpton to the westbound carriageway of the main new road (the slip road along this route being given number 6 on the plan) and

(c) A route from a new roundabout which the Secretary of State proposes to construct at Thrumpton to the eastbound carriageway of the main new road (the slip road along this route being given number 7 on the plan) and

(d) A route from the westbound carriageway of the main new road to a new roundabout which the Secretary of State proposes to construct at Thrumpton (the slip road along this route being given number 8 on the plan).

Article 6

SCHEDULE 3 SPECIFICATION OF THE PROPOSED ROAD AND BRIDGE OVER THE RIVER SOAR AT RATCLIFFE CUT IN THE COUNTY OF LEICESTERSHIRE

The specification of the proposed road and bridge is as follows:

(a) Point of Commencement – A point on the west bank of the Ratcliffe Cut 2.300 metres south of the point where the southern edge of the existing A453(T) bridge over the Cut meets its west bank.

(b) Point of Termination - A point on the east bank of the Ratcliffe Cut 2.300 metres south of the point where the southern edge of the existing A453(T) bridge over the Cut meets its east bank.

(c) Width - The bridge will have a width of 15.4 metres throughout its length.

(d) Headroom – Not less than 3.25 metres above the 100 year flood level of 30.97 metres A.O.D. to be maintained over the entire width of the waterway and towpath. The new bridge soffit will be a maximum of 150mm lower than the soffit of the existing adjacent bridge over the waterway.

(e) Waterway – No changes will be made to the existing canal profile beneath the bridge. The bed level will remain as at present.

(f) Towpath – A towpath of minimum width 3.000 metres will be maintained on the west side of the canal.
