The Secretary of State, in exercise of the powers conferred by section 7(4) of the Misuse of Drugs Act 1971( 1 ) and after consultation with the Advisory Council on the Misuse of Drugs in accordance with section 7(7) of that Act, makes the following Order:

Citation, commencement and extent

1. —(1) This Order may be cited as the Misuse of Drugs (Designation) (Amendment No.2) (England, Wales and Scotland) Order 2012 and shall come into force on 13 th June 2012.

(2) This Order extends to England and Wales and Scotland.

Amendment to the Misuse of Drugs (Designation) Order 2001

2. In Part 1 of the Schedule to the Misuse of Drugs (Designation) Order 2001( 2 ) after paragraph 1(r), insert—

(s) Any compound (not being pipradrol) structurally derived from piperidine, pyrrolidine, azepane, morpholine or pyridine by substitution at a ring carbon atom with a diphenylmethyl group, whether or not the compound is further modified in any of the following ways, that is to say,

(i) by substitution in any of the phenyl rings to any extent with alkyl, alkoxy, haloalkyl or halide groups;

(ii) by substitution at the methyl carbon atom with an alkyl, hydroxyalkyl or hydroxy group;

(iii) by substitution at the ring nitrogen atom with an alkyl, alkenyl, haloalkyl or hydroxyalkyl group. .
