The Secretary of State for Communities and Local Government, in exercise of the powers conferred by paragraphs 14(4) and (6) and 15(3) of Schedule 4B to the Town and Country Planning Act 1990( 1 ), makes the following Regulations.

Citation, commencement and interpretation

1. β€”(1) These Regulations may be cited as the Neighbourhood Planning (Prescribed Dates) Regulations 2012 and come into force on 1st September 2012.

(2) In these regulations β€œthe Act” means the Town and Country Planning Act 1990.

Prescribed dates

2. β€”(1) For the purposes of paragraph 14(4) and (6) of Schedule 4B to the Act, the prescribed date is the date on which the referendum is held.

(2) For the purposes of paragraph 15(3) of Schedule 4B to the Act, the prescribed date is the date on which the additional referendum is held.

1990 c.8 . Schedule 4B was inserted into the Act by section 116 of, and Schedule 10 to, the Localism Act 2011 (c. 20) . In the case of a referendum or additional referendum in respect of a neighbourhood development plan, Schedule 4B is applied with modifications by section 38A(3) of the Planning and Compulsory Purchase Act 2004 (c. 5) . See section 336(1) of the Town and Country Planning Act 1990 for the definition of β€œprescribed”.
