The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 45(7) and 46(1)(f) and (7) of the Road Traffic Act 1988( 1 ).

Representative organisations have been consulted in accordance with section 195(2) of that Act.

In determining the amount of the fees specified in these Regulations, the Secretary of State has taken into account the costs of the functions listed in paragraphs 21 to 27 of Schedule 1 to the Department for Transport (Fees) Order 2009( 2 ) and has taken into account the matters listed in Schedule 2 to that Order in determining the costs of those functions.

Citation and commencement

1. These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) Regulations 2012 and they come into force on 1st April 2012.

Amendment of Regulations

2.The Motor Vehicles (Tests) Regulations 1981( 3 ) are amended as follows.

Fees for examinations

3. —(1) Regulation 20 is amended as follows.

(2) In paragraph (1), for sub-paragraphs (e) and (ea) substitute—

(e) save as provided in paragraph (4), in the case of a vehicle in Class VI or VIA constructed or adapted to carry more than 22 passengers—

(i) if the vehicle is tested at premises designated under section 8(3) of the 1981 Act ( 4 ) where the testing station concerned has been appointed for an examination at the applicant’s request, £132,

(ii) in any other case, £139;

(ea) save as provided in paragraph (4), in the case of a vehicle in Class VI or VIA constructed or adapted to carry 22 passengers or less—

(i) if the vehicle is tested at premises designated under section 8(3) of the 1981 Act where the testing station concerned has been appointed for an examination at the applicant’s request, £106,

(ii) in any other case, £111; .

(3) In paragraph (4) in the Table, for each amount specified both in that Table and in column (1) in the following Table in relation to each type of fee, substitute the amount specified in column (2) of the following Table in relation to that amount.
