The National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013

These Regulations are made in exercise of the powers conferred by section 91 of the Education Act 2002( 1 ).

In accordance with section 96(2) and (3) of that Act, the Secretary of State for Education has given notice of the proposal to make these Regulations to associations of local authorities, bodies representing the interests of school governing bodies, organisations representing school teachers and to other persons with whom consultation appeared to the Secretary of State to be desirable.

In accordance with section 96(4) of that Act, the Secretary of State has given those bodies and persons a reasonable opportunity of submitting evidence and representations as to the issues arising from the proposal.

In accordance with section 96(5) of that Act, having considered the evidence and representations submitted, the Secretary of State has published a draft of the proposed regulations and a summary of the views expressed during the consultation, and has allowed a period of not less than one month for the submission of further evidence and representations as to the issues arising in accordance with section 96(6).

The Secretary of State now makes the following Regulations.

Citation and commencement

1. These Regulations may be cited as the National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013 and come into force on 1st September 2013.

Disapplication of the National Curriculum

2. —(1) Subject to the provisions of paragraph (2), the attainment targets, programmes of study and assessment arrangements( 2 ) specified in relation to each of the core and foundation subjects ( 3 )for the first, second, third and fourth key stages( 4 ) do not apply in relation to any pupil during the school year 2013 to 2014( 5 ).

(2) The attainment targets, programmes of study and assessment arrangements specified in relation to the core subjects continue to apply in relation to any pupil in —

(a) the first key stage; and

(b) the third and fourth year of the second key stage, that is, the period beginning at the same time as the school year in which the majority of pupils in his class attain the age of ten.

(3) The programmes of study specified in relation to the core subjects for the fourth key stage do not apply in relation to any pupil during the school year 2014 to 2015.

Revocation

3.The National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2012( 6 ) are revoked.

“Attainment targets”, “ programmes of study” and “assessment arrangements” are defined in section 76 of the Education Act 2002, as amended by the Childcare Act 2006 (c.21) section 48, Schedule 1, paragraph 3 and the Apprenticeships, Skills, Children and Learning Act 2009 (c.22) sections 174 and 192, Schedule 12, paragraphs 31 and 32.

The core and foundation subjects are specified in sections 84 and 85 of the Education Act 2002. Section 85 is substituted by section 74 of the Education and Inspections Act 2006 (c.40) , which is not yet in force.
