Citation and commencement

1. This Order may be cited as the Port Security (Port of Glasgow) Designation Order 2013 and comes into force on 9th January 2014.

Port boundary

2. —(1) For the purposes of the definition of “port” in regulation 2 of the Port Security Regulations 2009( 3 ), the boundary of the Port of Glasgow is defined as follows.

(2) The boundary is generally shown by the inner edge of the red line (identified in the legend to the plan as “Port Boundary”) on the plan in Part 1 of the Schedule.

(3) As to the areas on that plan marked “EMR”, “Adams”, “KGV”, “Christies” and “Nustar”, the boundary is more particularly shown by the inner edge of the red part of the red and blue line on each of the corresponding inset plans, in Part 2 of the Schedule, headed respectively “Inset Plan 1–EMR”, “Inset Plan 2–Adams”, “Inset Plan 3–KGV”, “Inset Plan 4–Christies” and “Inset Plan 5–Nustar”.

(4) Where the red line runs along a beach or foreshore, the boundary runs along the edge of the land on that beach or foreshore which is below the level of mean high water springs.

Glasgow Port Security Authority Limited

3. —(1) For the purposes of the Port Security Regulations 2009( 4 ), Glasgow Port Security Authority Limited (company number SC461640), a company limited by guarantee (“the Authority”), is designated as the port security authority for the port of Glasgow.

(2) The Authority is not to be regarded as the servant or agent of the Crown or as enjoying any status, immunity or privilege of the Crown and its property is not to be regarded as property of, or held on behalf of, the Crown.

Review

4. —(1) The Secretary of State must from time to time—

(a) carry out a review of this Order,

(b) set out the conclusions of the review in a report, and

(c) publish the report.

(2) In carrying out the review the Secretary of State must, so far as is reasonable, have regard to how Directive 2005/65/ECthe Port Security Regulations 2009) is implemented in other member States.

(3) The report must in particular—

(a) set out the objectives intended to be achieved by the regulatory system established by those Regulations and this Order,

(b) assess the extent to which those objectives are achieved, and

(c) assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

(4) The first report under this article must be published before 9th January 2019.

(5) Reports under this article are afterwards to be published at intervals not exceeding five years.
