The Port Security (Port of Belfast) Designation Order 2013

The Secretary of State for Transport makes this Order in exercise of the powers conferred by section 2(2) of the European Communities Act 1972( 1 ).

The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to port security, measures relating to the safety of ships and the health and safety of persons on them, and maritime transport( 2 ).

Citation and commencement

1. This Order may be cited as the Port Security (Port of Belfast) Designation Order 2013 and comes into force on 20th January 2014.

Port boundary

2. β€”(1) For the purposes of the definition of β€œport” in regulation 2 of the Port Security Regulations 2009( 3 ), the boundary of the Port of Belfast is shown by the inner edge of the red line on the plan in the Schedule to this Order.

(2) Where the red line runs along a beach or foreshore, the boundary runs along the edge of the land on that beach or foreshore which is below the level of mean high water springs.

Belfast Port Security Authority Limited

3. β€”(1) For the purposes of the Port Security Regulations 2009, Belfast Port Security Authority Limited (company number NI621841), a company limited by guarantee (β€œthe Authority”), is designated as the port security authority for the port of Belfast.

(2) The Authority is not to be regarded as the servant or agent of the Crown or as enjoying any status, immunity or privilege of the Crown and its property is not to be regarded as property of, or held on behalf of, the Crown.

Review

4. β€”(1) The Secretary of State must from time to timeβ€”

(a) carry out a review of this Order,

(b) set out the conclusions of the review in a report, and

(c) publish the report.

(2) In carrying out the review the Secretary of State must, so far as is reasonable, have regard to how Directive 2005/65/ECthe Port Security Regulations 2009( 4 )) is implemented in other member States.

(3) The report must in particularβ€”

(a) set out the objectives intended to be achieved by the regulatory system established by those Regulations and this Order,

(b) assess the extent to which those objectives are achieved, and

(c) assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

(4) The first report under this article must be published before 20th January 2019.

(5) Reports under this article are afterwards to be published at intervals not exceeding five years.
