The Localism Act 2011 (Commencement No. 2 and Transitional Provisions) Order 2013

The Secretary of State, in exercise of the powers conferred by section 240(2) and (7) of the Localism Act 2011( 1 ), makes the following Order:

Citation and interpretation

1. —(1) This Order may be cited as the Localism Act 2011 (Commencement No. 2 and Transitional Provisions) Order 2013.

(2) In this Order—

the Act” means the Localism Act 2011 ; and

the commencement date” means 1st April 2013.

Provisions coming into force on the commencement date in relation to England

2. The following provisions of the Act come into force on the commencement date in relation to England—

(a) section 180(1) so far as it inserts paragraphs 7A, 7B and 7C into Schedule 2 to the Housing Act 1996( 2 );

(b) section 180(2) and (3);

(c) section 181; and

(d) section 182.

Transitional provisions in relation to complaints against a social landlord

3. —(1) This article applies to a complaint which, before the commencement date

(a) was duly made to a housing ombudsman under a scheme approved by the Secretary of State under paragraph 3 of Schedule 2 to the Housing Act 1996; and

(b) has not yet been determined by the ombudsman.

(2) Where this article applies, a complaint is deemed to be duly made in accordance with paragraphs 7A, 7B and 7C of Schedule 2 to the Housing Act 1996 (as inserted by section 180(1) of the Act).
