The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to energy and energy sources, makes the following Regulations in exercise of the powers conferred by that section:

1.—(1) These Regulations may be cited as the Promotion of the Use of Energy from Renewable Sources (Amendment) Regulations 2013.

(2) These Regulations come into force on 1st June 2013.

Amendments to regulation 4 of the 2011 Regulations (duty to introduce measures)I2

2.—(1)Regulation 4 of the Promotion of the Use of Energy from Renewable Sources Regulations 2011(3) is amended as follows.

(2) In paragraph (3)(a)—

(a)for “within a reasonable period of time” substitute “by a date which occurs within a reasonable timetable”; and

(b)for “the date on which the calculation is made equals or exceeds 5.4%” substitute “that date is at least 5.4%”.

(3) In paragraph (3)(b)—

(a)for “within a reasonable period of time” substitute “by a date which occurs within a reasonable timetable”; and

(b)for “the date on which the calculation is made equals or exceeds 7.5%” substitute “that date is at least 7.5%”.

(4) In paragraph (3)(c)—

(a)for “within a reasonable period of time” substitute “by a date which occurs within a reasonable timetable”; and

(b)for “the date on which the calculation is made equals or exceeds 10.2%” substitute “that date is at least 10.2%”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, issued free of charge, amend the Promotion of the Use of Energy from Renewable Sources Regulations 2011 to correct drafting errors in regulation 4, which transposes Article 3(2) of Directive 2009/28/EC(4), as read with Article 4(4) of that Directive.

An impact assessment has not been prepared for these Regulations. An Explanatory Memorandum is available alongside these Regulations on www.legislation.gov.uk.
