The Oxford Health NHS Foundation Trust (Transfer of Trust Property) Order 2014

The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 213, 217(2) and 272(7) and (8) of the National Health Service Act 2006( 1 ), having regard to changes in the functions of the Oxford University Hospitals National Health Service Trust.

Citation, commencement and interpretation

1. β€”(1) This Order may be cited as the Oxford Health NHS Foundation Trust (Transfer of Trust Property) Order 2014 and comes into force on 14th July 2014.

(2) In this Orderβ€”

β€œthe trustees” means the trustees appointed for the Oxford UniversityHospitals National Health Service Trust( 2 );

β€œthe old Trust” means the Oxford Health NHS Foundation Trust( 3 );

β€œthe trust property” means the property specified in the schedule of trust property prepared and agreed by the old Trust and the trustees and signed on behalf of the old Trust on 15th May 2014 and the trustees on 10th May 2014.

Transfer of trust property

2. β€”(1) On the date that this Order comes into force the trust property, and any rights and liabilities arising from that property, are transferred from the old Trust to the trustees.

(2) Following the transfer in paragraph (1), in any instrument relating to the trust property, any reference to the trustees of the trust property or to the old Trust is to be construed as a reference to the trustees.

Established by S.I. 1993/2544 , amended by S.I. 1994/482 (which changed the name of the trust from the Churchill John Radcliffe National Health Service Trust to the Oxford Radcliffe Hospital National Health Service Trust), S.I. 1998/1227 (which changed the name of the trust to the Oxford Radcliffe Hospitals National Health Service Trust), S.I. 2000/961 , S.I. 2011/2397 (which, amongst other things, changed the name of the trust to the Oxford University Hospitals National Health Service Trust) and S.I. 2013/593 . See S.I. 2003/1093 which provided for the appointment of trustees to the NHS trust.
