The Plymouth College of Art (Transfer to the Higher Education Sector) Order 2014

The Secretary of State for Business, Innovation and Skills makes the following Order in exercise of the powers conferred by section 122A of the Education Reform Act 1988( 1 ).
In accordance with section 122A(1) of that Act, it appears to the Secretary of State that the full-time equivalent enrolment number of the institution conducted by Plymouth College of Art( 2 ) for courses of higher education exceeds 55 per cent of its total full-time equivalent enrolment number.
Citation, commencement and application
1. —(1) This Order may be cited as the Plymouth College of Art (Transfer to the Higher Education Sector) Order 2014 and comes into force on 4th July 2014.
(2) This Order applies in relation to England.
Transfer to the higher education sector
2. On 4th July 2014 Plymouth College of Art is transferred to the higher education sector.

1988 c.40 ; section 122A was inserted by section 74(1) of the Further and Higher Education Act 1992 (c.13) . By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 ( S.I. 1999/672 ), as amended by S.I. 2000/1829 , the power in section 122A is exercisable by the Secretary of State only in relation to England.
Incorporated on 30th September 1992 under section 15 of the Further and Higher Education Act 1992 (c.13) by the Education (Further Education Corporations) Order 1992 ( S.I. 1992/2097 ), with the name Plymouth College of Art and Design. The corporation changed its name to Plymouth College of Art on 16th December 2008.
