The Water Act 2014 (Commencement No. 1) Order 2014

The Secretary of State and the Welsh Ministers make the following Order in exercise of the powers conferred by section 94(3) and (6) of, and Schedule 12 to, the Water Act 2014( 1 ).
Citation and interpretation
1. —(1) This Order may be cited as the Water Act 2014 (Commencement No. 1) Order 2014.
(2) In this Order “the Act” means the Water Act 2014.
Provisions coming into force on 14th July 2014
2. The following provisions of the Act come into force on 14th July 2014—
(a) section 40(1) (charging of fees by assessors for the enforcement of water quality);
(b) Schedule 9 (publication requirements under the Land Drainage Act 1991( 2 )).
Provision coming into force on 1st October 2014
3. Section 59 of the Act (main rivers in England and Wales) comes into force on 1st October 2014.

2014 c.21 . The power in section 94(3) of the Act to appoint a day on which the remaining provisions of the Act shall come into force is vested in the “appropriate authority”. Section 94(6) of the Act states that the appropriate authority is the Secretary of State except as otherwise stated in the table in Schedule 12 to the Act. The appropriate authority in relation to section 40(1) of the Act is the Secretary of State, in relation to the power of the Secretary of State to make an order under section 86ZA of the Water Industry Act 1991 (c.56) (as inserted by section 40(1)), and is the Welsh Ministers, in relation to the power of the Welsh Ministers to make an order under section 86ZA of the Water Industry Act 1991 (as inserted by section 40(1)). The appropriate authority in relation to Schedule 9 to the Act is the Secretary of State. The appropriate authority in relation to section 59 of the Act is the Secretary of State, in relation to the main river map for England, and is the Welsh Ministers, in relation to the main river map for Wales.
