The Police (Promotion) (Amendment) Regulations 2014

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 50(2)(b) of the Police Act 1996( 1 ).

In accordance with section 50(2ZC)( 2 ) of that Act, the text of these Regulations has been approved by the College of Policing.

Citation and commencement

1. These Regulations may be cited as the Police (Promotion) (Amendment) Regulations 2014 and come into force on 1st October 2014.

Amendments to the Police (Promotion) Regulations 1996

2.The Police (Promotion) Regulations 1996( 3 ) are amended as follows.

3. In regulation 2, in the appropriate place insert—

“FT Programme” means a programme for the time being recognised by the Secretary of State for the purposes of these Regulations as the Constable to Inspector Fast Track Programme; .

4. In regulation 3—

(a) in paragraph (1), for “A constable” substitute “Subject to paragraph (2A), a constable”;

(b) in paragraph (2), for “A sergeant is qualified” substitute “Subject to paragraph (2B), a sergeant is qualified”;

(c) after paragraph (2), insert—

(2A) A constable participating in the FT Programme is qualified for promotion to the rank of sergeant if he has obtained a pass in the qualifying assessment for promotion to the rank of sergeant.

(2B) A sergeant participating in the FT Programme is qualified for promotion to the rank of inspector if he has obtained a pass in the qualifying assessment for promotion to the rank of inspector (including where part of that pass was obtained whilst the sergeant held the rank of constable, in accordance with paragraph 5(2A) of Schedule 1). .

5. In paragraph 5 of Schedule 1—

(a) in sub-paragraph (1), for “(1B),” substitute “(1B), (1C),”;

(b) in sub-paragraph (1A), for “(1B),” substitute “(1B), (1C),”;

(c) after sub-paragraph (1B), insert—

(1C) A constable participating in the FT Programme is eligible to take Part I of the qualifying assessment for promotion to the rank of sergeant. ;

(d) after sub-paragraph (2), insert—

(2A) A constable participating in the FT Programme is eligible to take Part I of the qualifying assessment for promotion to the rank of inspector. ;

(e) in sub-paragraph (3A), for “(3B),” substitute “(3B), (3C),”;

(f) after sub-paragraph (3B), insert—

(3C) A sergeant participating in the FT Programme is eligible to take Part I of the qualifying assessment for promotion to the rank of inspector. ;

(g) in sub-paragraph (5), for “A person” substitute “A person, other than a person participating in the FT Programme,”;

(h) after sub-paragraph (6), insert—

(7) Part IIB of the qualifying assessment may be taken by a constable participating in the FT Programme only if a pass has been obtained in Part I. .

Section 50 was amended by paragraph 3 of Schedule 22 to the Criminal Justice and Immigration Act 2008 (c. 4) , section 3 of the Policing and Crime Act 2009 (c. 26) , section 82(12) of, and paragraph 32 of Schedule 16 to, the Police Reform and Social Responsibility Act 2011 (c. 13) and section 123(1) of the Anti-Social Behaviour, Crime and Policing Act 2014 (c. 12) .

Section 50(2ZC) was inserted by section 123(1) of the Anti-Social Behaviour, Crime and Policing Act 2014 (c. 12) , with effect from 13th May 2014 ( S.I. 2014/949 ). Section 123 was the subject of a correction slip published on 4th August 2014.
