The Independent Police Complaints Commission (Investigation of Offences) Order 2014

The Secretary of State makes the following Order in exercise of the powers conferred by paragraph 19(6) and (6A) of Schedule 3 to the Police Reform Act 2002(1).

Citation, commencement, interpretation and extentI1

1.—(1) This Order may be cited as the Independent Police Complaints Commission (Investigation of Offences) Order 2014 and comes into force on 1st October 2014.

(2) In this Order—

the 1984 Act” means the Police and Criminal Evidence Act 1984 ( 2 );

Code B” means the code of practice issued under section 66(1)(c) and (d) of the 1984 Act( 3 );

Code C” means the code of practice issued under section 66(1)(b) of the 1984 Act;

prescribed investigation” means an investigation of an offence conducted by virtue of paragraph 19 of Schedule 3 to the Police Reform Act 2002 by [F1 a person F1] designated under that paragraph.

(3) This Order extends to England and Wales.

2. The provisions of the 1984 Act, Code B and Code C specified in the first column of a table in the Schedule apply to prescribed investigations subject to article 3.

3. For the purposes of prescribed investigations

(a)the authorisation required in relation to the exercise of the power in a provision of the 1984 Act specified in the first column of table 1 in the Schedule may be given by [F2a member of the IOPC’s staffF2] of or above the grade specified in the same row in the second column of the table;

(b)the authorisation required in relation to the exercise of the power in a provision of Code B listed in the first column of table 2 in the Schedule may be given by [F2a member of the IOPC’s staffF2] of or above the grade specified in the same row in the second column of the table;

(c)the authorisation required in relation to the exercise of the power in a provision of Code C listed in the first column of table 3 in the Schedule may be given by [F2a member of the IOPC’s staffF2] of or above the grade specified in the same row in the second column of the table.

Section 66 was amended by section 57(1) and (4) of the Criminal Justice and Court Services Act 2000 (c. 43). There are other amendments which are not relevant to the provision made by this Order.
