Coming into force in accordance with article 1

This Order is made in exercise of the powers conferred by sections 87(3)(b) and (5) and 210(7) of the Education Act 2002( 1 ).

In accordance with section 96( 2 )(2), (3) and (4) of that Act, the Secretary of State gave notice of the proposal to the bodies and persons mentioned in those subsections and gave them a reasonable opportunity of submitting evidence and representations as to the issues arising.

In accordance with section 96(5), the Secretary of State published a draft of the proposed order and the associated documents, and a summary of the views expressed.

In accordance with section 96(6), the Secretary of State allowed a period of not less than one month beginning with the publication of the draft of the proposed order for the submission of further evidence and representations as to the issues arising.

The Secretary of State now makes the following Order.

Citation and commencement

1. β€”(1) This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study) (England) (Amendment) (No. 3) Order 2014 and, subject to paragraph (2), comes into force on 1st September 2015.

(2) Article 3 comes into force on 1st August 2016.

Amendments to the Education (National Curriculum) (Attainment Targets and Programmes of Study) (England) Order 2013

2.The Education (National Curriculum) (Attainment Targets and Programmes of Study) (England) Order 2013( 3 ) is amended as follows.

3. In article 2(a) for β€œ16th July 2014” substitute β€œ2nd December 2014”.

4. After article 3(6) insertβ€”

β€œ (7) In relation to a pupil in the first year of the fourth key stage on or after 1st August 2016 but before 1st August 2017, it is directed that the provisions relating to programmes of study set out in the Framework Document have effect for the purposes of specifying the programme of study for the fourth key stage in relation to science.

(8) In relation to a pupil in the fourth key stage on or after 1st August 2017, it is directed that the provisions relating to programmes of study set out in the Framework Document have effect for the purposes of specifying the programme of study for the fourth key stage in relation to science. ” .

5. Article 6(2) is amended as followsβ€”

(a) omit the word β€œor” in sub-paragraph (b), and

(b) in sub-paragraph (c)β€”

(i) for β€œ1st August 2015” substitute β€œ1st August 2016”, and

(ii) after the word β€œscience” insertβ€”

β€œ ; or

(d) is in the final year of the fourth key stage on or after 1st August 2016 but before 1st August 2017 for the purposes of specifying the programme of study for the fourth key stage in relation to science ” .
