The Secretary of State, being a Minister designated( 1 ) for the purposes of section 2(2) of the European Communities Act 1972( 2 ) in relation to measures relating to copyright and rights in performances, in exercise of powers conferred by that section and section 78 of the Enterprise and Regulatory Reform Act 2013( 3 ) makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Copyright and Duration of Rights in Performances (Amendment) Regulations 2014 and come into force on 6th April 2014.

Amendment to the Copyright, Designs and Patents Act 1988

2. In section 191HA(1) of the Copyright, Designs and Patents Act 1988( 4 ), after “a performer has” insert “by an agreement”.

Section 191HA was inserted into the Copyright, Designs and Patents Act 1988 (c.48) by the Copyright and Duration of Rights in Performances Regulations 2013 ( S.I. 2013/1782 ), regs 3 and 9.
