The Coal Industry Act 1994 (Commencement No. 8 and Transitional Provision) Order 2014

The Secretary of State, in exercise of the powers conferred by section 68(4) and (5)(b) of the Coal Industry Act 1994( 1 ), makes the following Order:

Citation

1. —(1) This Order may be cited as the Coal Industry Act 1994 (Commencement No. 8 and Transitional Provision) Order 2014.

(2) In this Order, “the Act” means the Coal Industry Act 1994.

Commencement of provisions

2. Subject to article 3, the following provisions come into force on 28th April 2014—

(a) section 67(8) of the Act, so far as it relates to provisions coming into force by virtue of paragraph (b);

(b) Part 3 of Schedule 11 to the Act, so far as it relates to the repeals set out in the Schedule to this Order.

Transitional provision

3. Any redundant mineworkers and concessionary coal payments scheme made under, or continued in force by virtue of, section 7 of the Coal Industry Act 1977( 2 ) continues to have effect for the purpose of the recovery of any overpayments, notwithstanding the repeal of that provision.

1977 c. 39 ; amended by sections 7 and 11 of the Coal Industry Act 1980 (c. 50) , section 4 of the Coal Industry Act 1983 (c. 60) , section 3(1) and (2) of the Coal Industry Act 1985 (c. 27) , section 1(2) of, and paragraph 34 of Schedule 1 to, the Coal Industry Act 1987 (c. 3) and by S.I. 1986/631 . Some payments schemes were made under section 3 of the Coal Industry Act 1967 (c. 91) . That provision was repealed by the Coal Industry Act 1977, but section 7(10) of that Act contained a saving for those schemes.
