The Pensions Act 2014 (Commencement No. 5) Order 2015

The Secretary of State for Work and Pensions makes the following Order in exercise of the powers conferred by section 56(1), (4) and (7) of the Pensions Act 2014( 1 ).

Citation and interpretation

1. β€”(1) This Order may be cited as the Pensions Act 2014 (Commencement No. 5) Order 2015.

(2) In this Order, β€œthe Act” means the Pensions Act 2014.

Commencement of provisions

2. β€”(1) The following provisions of the Act come into force only for the purposes of making regulations on the day after this Order is madeβ€”

(a) section 24(1) (abolition of contracting-out for salary related schemes etc. ) and paragraph 1 of Schedule 13 (abolition of contracting-out for salary related schemes), only in so far as they relate to the provisions specified in sub-paragraphs (b) and (c);

(b) paragraph 24 (substitution of part of section 37 (alteration of rules of contracted-out schemes) of the Pension Schemes Act 1993( 2 )) of Schedule 13; and

(c) paragraph 25 (insertion of section 37A (transfer of liabilities etc : schemes contracted-out on or after 6th April 1997) into the Pension Schemes Act 1993( 3 )) of Schedule 13.

(2) The following provisions of the Act come into force on the day after this Order is madeβ€”

(a) section 23 (amendments) and paragraphs 8 and 88 of Schedule 12 (state pension: amendments), only in so far as they relate to the provisions specified in sub-paragraphs (c) and (d);

(b) section 28(3) (state pension credit: phasing out assessed income periods);

(c) paragraph 25 of Schedule 12; and

(d) paragraph 90 of Schedule 12.

3. The following provisions of the Act only in so far as they are not already in force, come into force on 12th October 2015β€”

(a) section 25 (option to boost old retirement pensions) only in so far as it relates to the provisions specified in paragraph (b); and

(b) paragraphs 1 to 10 and 12 to 14 of Schedule 15 (option to boost old retirement pensions).

4. Section 28(1) and (2) of the Act comes into force on 6th April 2016.
