The Motor Vehicles (Variation of Speed Limits for Naval, Military and Air Force Vehicles) (England and Wales) Regulations 2015

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 130(3) of the Road Traffic Regulation Act 1984( 1 ) after consultation with representative organisations in accordance with section 134(2)( 2 ) of that Act.

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Motor Vehicles (Variation of Speed Limits for Naval, Military and Air Force Vehicles) (England and Wales) Regulations 2015 and come into force on 1st October 2015.

(2) These Regulations extend to England and Wales.

Variation of speed limit for naval, military and air force track-laying vehicles

2. —(1)Schedule 6 to the Road Traffic Regulation Act 1984 (speed limits for vehicles of certain classes) is amended as follows.

(2) In the table in Part III (track-laying vehicles), after item 5 insert—

A motor vehicle of a class specified in item 1 or 2 above, or in item 5 as a result of paragraph (a) of the class description of that item, which—

(a)

is being used for naval, military or air force purposes,

(b)

is being driven by persons for the time being subject to the orders of a member of the armed forces of the Crown, and

(c)

is being used in England or Wales.

(3) In paragraph 4 of Part IV (application and interpretation)

(a) the existing text becomes sub-paragraph (1);

(b) after sub-paragraph (1) insert—

(2) A vehicle falling in the class specified in item 6 in Part III shall be treated as falling in that class (and not as also falling in any other class).
