The Protected Disclosures (Extension of Meaning of Worker) Order 2015

The Secretary of State makes the following Order in exercise of the powers conferred by section 43K(4) of the Employment Rights Act 1996( 1 ).

In accordance with section 236(3) of the Employment Rights Act 1996( 2 ) a draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament.

Citation and Commencement

1. This Order may be cited as the Protected Disclosures (Extension of Meaning of Worker) Order 2015 and comes into force on 6th April 2015.

Amendment to the Employment Rights Act 1996

2. —(1) Section 43K of the Employment Rights Act 1996 (extension of meaning of “worker etc. for Part 4A) is amended as follows.

(2) Before subsection (1)(d) insert—

(cb) is or was provided with work experience provided pursuant to a course of education or training approved by, or under arrangements with, the Nursing and Midwifery Council in accordance with article 15(6)(a) of the Nursing and Midwifery Order 2001 ( S.I. 2002/253 ), or .( 3 )

(3) In subsection (2)(c) after “paragraph” insert “(cb) or”.
