The Armed Forces (Enhanced Learning Credit Scheme and Further and Higher Education Commitment Scheme) (Amendment) Order 2015

The Secretary of State, in exercise of the powers conferred by sections 1(1) and (3) of the Armed Forces (Pensions and Compensation) Act 2004( 1 ), makes the following Order:

Citation, commencement and interpretation

1. —(1) This Order may be cited as the Armed Forces (Enhanced Learning Credit Scheme and Further and Higher Education Commitment Scheme) (Amendment) Order 2015 and comes into force on 1st April 2015.

(2) In this Order “the principal Order” means the Armed Forces (Enhanced Learning Credit Scheme and Further and Higher Education Commitment Scheme) Order 2012( 2 ).

Amendment to the principal Order

2. The principal Order is amended —

(a) in article 10(9) by substituting “the United Kingdom” for “Great Britain”,

(b) in article 11(8) by substituting “the United Kingdom” for “Great Britain”,

(c) after article 12(5) by inserting—

(6) Where an approved learning provider is located in Northern Ireland, “capped fees” means the higher amount which that establishment may lawfully charge a person under the Student Fees (Amounts) Regulations (Northern Ireland) 2005 ( 3 ) provided that—

(a) the course is a “qualifying course” within the meaning of regulation 4 of the Student Fees (Qualifying Courses and Persons) Regulations (Northern Ireland) 2007 (“the 2007 regulations ”) ( 4 ) , and

(b) the person is a “qualifying person” within the meaning of regulation 5 of the 2007 regulations.
