Extradition

The Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 9 and Transitional Provisions) Order 2015

The Secretary of State, in exercise of the power conferred by section 185(1) and (7) of the Anti-social Behaviour, Crime and Policing Act 2014( 1 ), makes the following Order.

Citation

1. This Order may be cited as the Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 9 and Transitional Provisions) Order 2015.

Provisions coming into force on 15th April 2015

2. The following provisions of the Anti-social Behaviour, Crime and Policing Act 2014 come into force on 15th April 2015β€”

(a) section 160 (appeals);

(b) section 181(1) (minor and consequential amendments), insofar as it relates to the provisions of Schedule 11 specified in paragraph (c); and

(c) in Schedule 11 (minor and consequential amendments)β€”

(i) paragraphs 106 to 107;

(ii) paragraphs 111 to 112;

(iii) paragraph 113(1) to (2); and

(iv) paragraph 114.

Provisions coming into force on 15th April 2015 in relation to England and Wales and Northern Ireland

3. The following provisions of the Anti-social Behaviour, Crime and Policing Act 2014 come into force on 15th April 2015 in relation to England and Wales and Northern Ireland onlyβ€”

(a) section 181(1) (minor and consequential amendments), insofar as it relates to the provisions of Schedule 11 specified in paragraph (b); and

(b) in Schedule 11 (minor and consequential amendments), paragraph 113(3) to (6).

Transitional provisions

4. β€”(1) The amendments made by the commencement of the provisions referred to in articles 2 and 3 shall not apply in a case where notice of appeal was given under section 26, 28, 103, 105, 108 or 110 of the Extradition Act 2003( 2 ) before 15th April 2015.

(2) In relation to Scotland, until the coming into force of paragraphs 10 to 15 (human rights issues) of Schedule 20 (extradition) to the Crime and Courts Act 2013( 3 ), section 108(4)(b) of the Extradition Act 2003 has effect as if the reference to section 108(5) were omitted.
