The Secretary of State, having had regard to the matters specified in section 93(6) of the Environment Act 1995 (“the Act”)( 1 ) and after consultation in accordance with section 93(2) of the Act, makes these Regulations in exercise of the powers conferred by sections 93(1) and (8) and 94(1)(b), (c) and (d), and (7) of the Act.
Citation and commencement
1. These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) Regulations 2016 and come into force on 20th December 2016.
Amendment of 2007 Regulations
2. —(1) Schedule 2 to the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (recovery and recycling obligations)( 2 ) is amended as follows.
(2) In paragraph 3(4)—
(a) for the formula substitute—
(b) omit the definition of “W”.
(3) In paragraph 6—
(a) omit “at the head of the subsequent columns”;
(b) for Table 2 substitute—

Revocation of 2014 Regulations
3. The Producer Responsibility Obligations (Packaging Waste) (Amendment) Regulations 2014( 3 ) are revoked.
