The Control of Noise (Appeals) (Amendment) (England) Regulations 2016

The Secretary of State makes these Regulations in exercise of the powers conferred by sections 70(2) and (3) and 104(1) of the Control of Pollution Act 1974( 1 ).

Citation, commencement and application

1. These Regulations

(a) may be cited as the Control of Noise (Appeals) (Amendment) (England) Regulations 2016;

(b) come into force on 6th April 2016; and

(c) apply to England only.

Amendment of the Control of Noise (Appeals) Regulations 1975

2. —(1) The Control of Noise (Appeals) Regulations 1975( 2 ) are amended as follows.

(2) Omit regulation 7 (appeals under section 66(7)).

(3) Omit Part 3 (appeals to the Secretary of State).

(4) In regulation 10 (suspension of notices)

(a) in paragraph (1), after “a notice served under section 60” omit “, or 66”; and

(b) in paragraph (3), after “magistrates’ court” omit “or the Secretary of State”.
