The Small Business, Enterprise and Employment Act 2015 (Commencement No. 5 and Saving Provision) Regulations 2016

The Secretary of State in exercise of the powers conferred by sections 160(1), 161(1), 161(2) and 164(1) of the Small Business, Enterprise and Employment Act 2015( 1 ) makes the following Regulations.
Citation and interpretation
1. โ(1) These Regulations may be cited as the Small Business, Enterprise and Employment Act 2015 (Commencement No. 5 and Saving Provision) Regulations 2016.
(2) In these Regulations, โthe Actโ means the Small Business, Enterprise and Employment Act 2015.
Provisions coming into force on 2nd May 2016
2. The following provisions of the Act come into force on 2nd May 2016โ
(a) section 41 (the Adjudicator) and Part 1 (the Pubs Code Adjudicator) and Part 3 (amendments of legislation) of Schedule 1;
(b) section 63 (levy funding);
(c) section 64 (loans by Secretary of State); and
(d) section 65 (review of Adjudicator and guidance from Secretary of State).
Provisions coming into force on the later of 26th May 2016 or the day after the day on which the Pubs Code etc. Regulations 2016 are made
3. The provisions in Part 4 of, and Schedule 1 to, the Act come into force, to the extent that they are not yet in force, on the later ofโ
(a) 26th May 2016; or
(b) the day after the day on which the Pubs Code etc. Regulations 2016( 2 ) are made.
Provision coming into force on 1st June 2016
4. โ(1) Section 38 of the Act (exemption from liability for bodies concerned with accounting standards etc ) comes into force on 1st June 2016, to the extent that it is not yet in force.
(2) The repeal of section 18 of the Companies (Audit, Investigations and Community Enterprise) Act 2004 (exemption from liability)( 3 ), resulting from paragraph (1), does not affect any exemption from liability arising under that section in respect of acts or omissions occurring before 1st June 2016.
