The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972( 1 ) in relation to matters relating to copyright( 2 ).

The Secretary of State, in exercise of the powers conferred by section 2(2) of that Act, makes the following Regulations:

(a) at the end of subsection (1)(a) insert “or”;

(b) in subsection (1)(b), omit “; or”;

(c) omit subsection (1)(c); and

(d) in subsection (1B), insert “film or” before “excepted sound recording”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Section 72 of the Copyright, Designs and Patents Act 1988(“the 1988 Act”) provides an exception to the infringement of certain works included within a broadcast where it is shown or played to an audience who have not paid for admission to the place where the broadcast is to be seen or heard.

This instrument implements Article 3 of of the European Parliament and of the Council of 22 May 2001 (OJ No L 167, 22.6.2001, p10) (in part) in the light of the decision in Directive 2001/29/EC Football Premier League Ltd. v. QC Leisure and Others [2012] EWCA Civ 1708. In particular, these Regulations amend section 72(1) of the Copyright, Designs and Patents Act 1988 by removing “film” from the scope of the exception. In addition, these Regulations amend section 72(1B) by inserting the word “film” before “excepted sound recording” in order to retain an exception to infringement of the copyright in a film included within a broadcast where the showing or playing to the public of a broadcast is necessary for the purposes of repairing or demonstrating equipment.
