The Secretary of State, in exercise of the powers conferred by section 52(2) of the Modern Slavery Act 2015( 1 ), makes the following Regulations:

Citation and commencement

1. —(1) These Regulations may be cited as the Modern Slavery Act 2015 (Duty to Notify) (Amendment) Regulations 2016.

(2) These Regulations come into force on 10th August 2016.

Amendments to the Modern Slavery Act 2015 (Duty to Notify) Regulations 2015

2. —(1)The Modern Slavery Act 2015 (Duty to Notify) Regulations 2015( 2 ) are amended as follows.

(2) In regulation 3(1), for “paragraphs (2) and (4)”, substitute “paragraph (2), as read with paragraph (2A), and paragraph (4)”.

(3) In regulation 3(2), for “person”, substitute “victim” in each place in which it occurs.

(4) After regulation 3(2), insert—

(2A) Nothing in paragraph (2) shall be read as requiring the consent of any person in paragraph 4 of Schedule 2 whom the public authority believes may also have been the victim of slavery or human trafficking by the same perpetrator. .

(5) In paragraph 8(2) of Schedule 1, omit “the public authority must include” and “in the notification”.
