The Immigration (Guidance on Detention of Vulnerable Persons) Regulations 2016

The Secretary of State makes the following Regulations in exercise of powers conferred by section 59(5) of the Immigration Act 2016( 1 ).

In accordance with section 59(4) of that Act, draft guidance has been laid before Parliament specifying matters to be taken into account in determining whether a person would be particularly vulnerable to harm if that person were to be detained or to remain in detention and, if so, whether that person should be detained or remain in detention.

Citation and commencement

1. These Regulations may be cited as the Immigration (Guidance on Detention of Vulnerable Persons) Regulations 2016 and come into force on 12th September 2016.

Guidance

2. The guidance on adults at risk in immigration detention issued under section 59(1) of the Immigration Act 2016, a draft of which was laid before Parliament by the Secretary of State on 21st July 2016, comes into force on 12th September 2016.
