M1,M2 The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 . The Secretary of State is a minister designated for the purposes of that section in relation to electronic communications.

Citation and commencement

1. These Regulation may be cited as the 2010-2025 MHz Frequency Band (Management) Regulations 2016 and come into force on 29th September 2016.

Designation of the 2010-2025 MHz frequency band

2. —(1) OFCOM must designate and make available, on a non-exclusive basis, the band for video PMSE, in accordance with the parameters set out in the Annex to the Decision.

(3) Upon detection of interference to other types of spectrum users or services that are entitled to use the band on 10th September 2016, OFCOM may restrict the use of video PMSE in the relevant portion of the band in specific geographic areas in accordance with the Annex to the Decision.

(4) In this regulation—

M3 the Decision ” means Commission Implementing Decision (EU) 2016/339 on the harmonisation of the 2010-2025 MHz frequency band for portable or mobile wireless video links and cordless cameras used for programme making and special events ;

M4 OFCOM ” means the Office of Communications as established by section 1 of the Office of Communications Act 2002 ;

the band ” means the 2010-2025 MHz frequency band;

video PMSE ” means wireless video links that can be portable or mobile and cordless cameras, used for programme making and special events.
