The Energy Act 2016 (Commencement No. 2 and Transitional Provisions) Regulations 2016

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 84(3) and (4) of the Energy Act 2016( 1 ).
Citation
1. These Regulations may be cited as the Energy Act 2016 (Commencement No. 2 and Transitional Provisions) Regulations 2016.
Provisions coming into force on 1st October 2016
2. The following provisions of the Energy Act 2016 come into force on 1st October 2016, so far as not already in force —
(a) Part 1 (the OGA) and Schedule 1 (transfer of functions to the OGA),
(b) Part 2 (further functions of the OGA relating to offshore petroleum), except sections 30 to 36 (information and samples plans, power to require information and samples, coordinators and related appeals), and
(c) Part 3 (infrastructure and information) and Schedule 2 (abandonment of offshore installations).
Transitional Provisions
3. From 1st October 2016, the Oil and Gas Authority (Levy) Regulations 2016( 2 ) have effect as if—
(a) the Regulations were made under sections 13, 14 and 82 of the Energy Act 2016,
(b) any amount payable to the Secretary of State under those Regulations which has not been paid before 1st October 2016 is payable to the OGA( 3 ), and
(c) any amount payable by the Secretary of State under those Regulations which has not been paid before 1st October 2016 is payable by the OGA.

The OGA is defined as the Oil and Gas Authority in section 1(4) of the Energy Act 2016.
