The Secretary of State makes the following Order in exercise of the powers conferred by section 8 of the Animals (Scientific Procedures) Act 1986(1).

Citation, commencement, interpretation and extentI1

1.—(1) This Order may be cited as the Animals (Scientific Procedures) Act 1986 (Fees) Order 2018 and comes into force on 6th April 2018.

(2) In this Order the “1986 Act” means the Animals (Scientific Procedures) Act 1986.

(3) This Order extends to England and Wales and Scotland.

Additional fees payable under the Animals (Scientific Procedures) Act 1986 for the period of twelve months beginning with 6th April 2018I2

2.—(1) In addition to the fees payable under the Animals (Scientific Procedures) Act 1986 (Fees) Order 2015(2), in respect of the period of twelve months beginning with 6th April 2018 the holder of a licence issued under section 2C of the 1986 Act (licensing of undertakings)(3) which authorises the holder to carry on an undertaking involving any of the activities mentioned in section 2B(2) of the 1986 Act (prohibition of unlicensed undertakings)(4) must pay an additional fee which is to be determined as follows.

(2) The additional fee is to have a fixed and a variable element.

(3) The fixed element of the additional fee for such a licence which is in force for the whole or any part of that period is £126.

(4) The variable element of the additional fee is £15 for each person who during the whole or any part of that period holds a personal licence which specifies the establishment of the section 2C licence holder to which the licence relates as the place where the personal licence is primarily available.

(5) If any person holds a licence under section 2C only during the period beginning with 1st April 2019 and ending with 5th April 2019 the only fee payable is a fee, determined in accordance with paragraphs (2) to (4) as if it were an additional fee.

3.—(1) The fee payable by the holder of a licence issued under section 2C of the 1986 Act which authorises the holder to carry on an undertaking involving any of the activities mentioned in section 2B(2) of the 1986 Act is to be determined as follows.

(2) In respect of the period of twelve months beginning with 6th April 2019 and in respect of subsequent twelve month periods, there is to be a fixed and a variable element of the fee.

(3) The fixed element for such a licence which is in force for the whole or any part of that period is £757.

(4) The variable element is £257 for each person who during the whole or any part of that period holds a personal licence which specifies the establishment of the section 2C licence holder to which the licence relates as the place where the personal licence is primarily available.

4.The Animals (Scientific Procedures) Act 1986 (Fees) Order 2015 is revoked.
